KARACHI: A district and sessions judge recorded on Tuesday the testimonies of three prosecution witnesses in a gang-rape case.
The medico-legal officer, Dr Zaib-un-Nisa, the victim’s younger brother Ali Asghar and uncle Jamaluddin appeared before the judge, Faheem Ahmed Siddiqui, as witnesses and testified.
The accused – Abdul Jabbar, Ali Hasan, Shah Zado, Bashir Ahmed, Anwar Hussain, Khadim Hussain and Shah Baig – along with their absconding accomplices were charged with kidnapping Naseema Lubano, 18, from her house in district Ghotki in January 2007 and subjecting her to gang-rape.
The MLO testified that the victim came to the hospital for a medical examination on Jan 27, 2007 and disclosed that she was subjected to gang-rape. She added that she took internal and external swabs and sent the same for a chemical analysis.
The MLO concluded that after the receipt of the chemical report she issued a final medico-legal certificate, according to which the victim was subjected to gang-rape.
The victim’s brother deposed that the accused broke into their house and kidnapped his sister in his presence, adding that he went out into the streets, crying for help.
The last witness, Jamaluddin, said in his statement that after hearing the hue and cry, he went to the house of the absconding accused Abdul Sattar. He said that when he entered the house, he saw the victim was there and the accused were around her. He added that he begged the accused to release the victim.
After the completion of testimonies, the court adjourned the hearing till Aug 8.
According to the prosecution, the accused equipped with arms had broken into the house of Nasima Lubano, daughter of Hamzu, on Jan 27, 2007 and kidnapped her. Later, they took the victim to the residence of an accused, where she was subjected to gang-rape.
A case (FIR No. 07/07) was registered against the accused at Ubaro police station on the complaint of the victim’s father.
Bail application dismissed
Meanwhile, the same court dismissed on Tuesday the bail application of an accused in another gang-rape case.
The accused, Roshan Aleem, through his counsel filed a bail application and the judge pronounced the order after hearing arguments from both sides.
Accused Shaban Sheikh, Sheikh Ashan, Roshan Aleem and Kaleemullah are facing charges of kidnapping 13-year-old Kainat Soomro in January 2007 from her native village in Dadu district and subjecting her to gang-rape.
